These Terms of Service govern access to petalandpupi.shop and purchases made through the website.

By using the website or placing an order, you agree to these Terms of Service. Mandatory consumer rights under German and European Union law remain unaffected.

1. Website Operator and Contact

The online store is operated under the trading name:

petalandpupi.shop
Email: info@petalandpupi.shop

2. Scope

These Terms apply to contracts for products offered through petalandpupi.shop, including women’s dresses, mini dresses, jeans, skirts, trousers and other fashion products.

Any conflicting customer terms apply only if expressly accepted by us in writing.

3. Customer Eligibility

Customers must have the legal capacity required to enter into a binding purchase contract.

Minors may place an order only with the permission of a parent or legal guardian and where the transaction is legally valid.

Products are offered primarily to consumers purchasing for personal use. Resale, unauthorised commercial purchasing and fraudulent transactions may be rejected where legally permitted.

4. Product Information

We aim to describe products accurately, including their main characteristics, available sizes, colours, materials and care information.

Minor differences may occur because:

  • Device screens display colours differently

  • Photography lighting affects appearance

  • Manufacturing processes may produce reasonable variations

  • Size labelling may differ between styles

Customers should review the complete product description and size information before ordering.

We may correct typographical errors, inaccurate descriptions or obvious pricing mistakes. If a correction materially affects an order already submitted, we will contact the customer and provide an appropriate opportunity to confirm or cancel the order.

5. Product Availability

Products remain available while stocks last.

Adding a product to a shopping cart does not reserve it. If a product becomes unavailable after an order is placed, we will notify the customer and refund any payment received for the unavailable product.

We may limit quantities where reasonably necessary to prevent fraud, resale abuse, inventory errors or disproportionate purchasing.

6. Prices

Prices displayed on the website are shown in the currency indicated during shopping and checkout.

Where applicable, prices include legally required taxes unless clearly stated otherwise.

The total price payable, including any applicable taxes, discounts and delivery charges, is displayed before the customer submits the order.

All orders qualify for free standard shipping under our Shipping Policy.

7. Ordering Process

Customers select products, place them in the shopping cart, enter delivery and payment information, review the order and submit it using the final order button.

Before submitting an order, the customer may review and correct input errors using the checkout controls.

Submitting an order constitutes a binding offer to purchase the products in the cart.

8. Contract Formation

An automated order acknowledgement confirms that we received the order. It does not necessarily constitute acceptance unless the communication expressly states that the order has been accepted.

The purchase contract is formed when we:

  • Send an express order-acceptance or dispatch confirmation;

  • Dispatch the products; or

  • Otherwise clearly accept the customer’s order.

We may reject an order for legitimate reasons, including product unavailability, unsuccessful payment, suspected fraud, obvious pricing errors, delivery restrictions or violation of these Terms.

If payment has been collected for a rejected order, it will be refunded.

9. Contract Language and Storage

The contract may be concluded in English unless another language is expressly offered during checkout.

Order information and these Terms may be stored electronically. Customers should save or print the order confirmation and applicable policies for their records.

10. Payment

Available payment methods are displayed at checkout and may vary by customer location, device or order.

Payment may be processed by an independent payment provider. Customers must provide complete and accurate billing and payment information.

An order may be delayed or cancelled if:

  • Payment is declined

  • Authentication is not completed

  • Payment information cannot be verified

  • Fraud or security concerns arise

  • The payment provider restricts the transaction

Customers remain responsible for charges lawfully incurred through their selected payment method.

11. Delivery

All orders receive free standard shipping.

The estimated delivery time is 15–20 days, subject to the Shipping Policy and circumstances outside our reasonable control.

Customers must provide a complete and accurate delivery address. We are not responsible for delays caused by incomplete or incorrect information supplied by the customer.

Where an order is delivered in separate packages, the customer may receive more than one tracking number or delivery.

12. Transfer of Risk

For consumer purchases, the risk of accidental loss or damage generally passes to the customer when the customer, or a third party designated by the customer other than the carrier, takes physical possession of the products.

Different rules may apply if the customer independently commissions a carrier that was not offered by us.

13. Retention of Title

Products remain our property until the purchase price has been paid in full, to the extent permitted by applicable law.

14. Right of Withdrawal

Eligible consumers may have a statutory right to withdraw from a distance contract within 14 days without providing a reason.

Details about exercising the right of withdrawal, returning products and receiving refunds are set out in our Return and Refund Policy.

Nothing in these Terms limits a mandatory statutory withdrawal right.

15. Returns and Refunds

Returns and refunds are handled under our Return and Refund Policy.

Customers are responsible for direct return shipping costs for ordinary withdrawal returns unless otherwise stated or legally required.

Where a product is defective, damaged, incorrect or otherwise non-conforming, mandatory statutory remedies apply.

16. Conformity and Statutory Warranty Rights

We are responsible for providing products that conform to the contract as required by applicable law.

A product may be non-conforming if it:

  • Does not match the agreed description

  • Lacks an agreed characteristic

  • Is not fit for its ordinary or agreed purpose

  • Is not supplied with agreed accessories

  • Does not meet applicable objective conformity requirements

Available remedies may include repair, replacement, price reduction, cancellation or refund, subject to applicable legal conditions.

Any voluntary commercial policy is provided in addition to, and does not replace, statutory warranty rights.

17. Care and Use of Products

Customers should follow washing, care, storage and use instructions supplied with the product.

We are not responsible for damage caused solely by:

  • Failure to follow care instructions

  • Incorrect washing or drying

  • Unauthorised alteration

  • Misuse

  • Normal wear and tear

  • Damage occurring after risk has passed to the customer

This section does not exclude liability for an original defect or other non-conformity for which we are legally responsible.

18. Customer Accounts

Customers may be able to create an account.

Customers are responsible for:

  • Keeping login credentials confidential

  • Providing accurate account information

  • Preventing unauthorised use

  • Informing us of suspected unauthorised access

We may suspend an account where reasonably necessary to protect the customer, other users or our systems.

19. Acceptable Use

You must not use the website to:

  • Violate applicable law

  • Commit fraud

  • Submit false payment or identity information

  • Interfere with website security

  • Introduce malware or harmful code

  • Scrape or copy content through unauthorised automated means

  • Infringe intellectual-property rights

  • Harass customers, staff or third parties

  • Place orders using stolen payment information

  • Attempt to gain unauthorised access to systems or accounts

  • Resell products in violation of an express purchasing restriction

We may restrict access or cancel affected transactions where reasonably necessary and legally permitted.

20. Intellectual Property

The website and its content, including text, product presentation, graphics, logos, layout, photographs and software, may be protected by copyright, trademark and other intellectual-property rights.

Content may be used for personal, non-commercial shopping purposes only.

No content may be reproduced, republished, distributed, modified or commercially exploited without prior permission, except where permitted by law.

21. Customer Reviews and Submitted Content

If customers submit reviews, photographs, comments or other content, they confirm that:

  • They have the right to submit it

  • It does not violate another person’s rights

  • It is not unlawful, fraudulent, misleading or abusive

Where a customer voluntarily submits content for publication, the customer grants us a non-exclusive licence to display and technically reproduce that content for operating and promoting the website, subject to applicable data-protection law.

We may remove unlawful, irrelevant, misleading or abusive content.

22. Third-Party Services and Links

The website may include services or links provided by third parties, such as payment processors, social networks or delivery tracking providers.

Third-party services are governed by their own terms and privacy notices. We are not responsible for third-party content or services except to the extent liability cannot legally be excluded.

23. Promotions and Discount Codes

Promotions and discount codes may be subject to specific conditions displayed with the offer.

Unless otherwise stated:

  • Discount codes cannot be exchanged for cash

  • Only one code may be used per order

  • Codes may have an expiry date

  • Codes may apply only to selected products

  • Codes may not apply retrospectively

  • Promotions remain subject to product availability

We may cancel a promotion or refuse a code where it is used fraudulently or contrary to its published conditions.

24. Liability

We do not exclude or limit liability where exclusion or limitation is prohibited by law.

In particular, nothing in these Terms excludes or limits liability for:

  • Intentional misconduct

  • Gross negligence

  • Injury to life, body or health

  • Fraudulent concealment of a defect

  • A guarantee expressly provided

  • Mandatory product-liability obligations

  • Other liability that cannot legally be excluded

For ordinary negligence involving a material contractual obligation, liability may be limited, where legally permitted, to foreseeable damage typical for the contract.

A material contractual obligation is one whose fulfilment makes proper performance of the contract possible and on which the customer may ordinarily rely.

25. Events Beyond Reasonable Control

We are not responsible for a delay caused by circumstances beyond our reasonable control, including severe weather, natural disasters, epidemics, government restrictions, war, civil disturbance, carrier disruption, customs delay, infrastructure failure or major technology outages.

We will take reasonable steps to reduce the effect of the disruption and perform our obligations as soon as reasonably possible.

Mandatory customer rights remain unaffected.

26. Data Protection

Personal data is processed in accordance with our Privacy Policy and applicable data-protection law.

27. Consumer Dispute Resolution

We encourage customers to contact info@petalandpupi.shop so that complaints can be reviewed directly.

Unless participation is required by applicable law, petalandpupi.shop is neither willing nor obliged to participate in dispute-resolution proceedings before a consumer arbitration board.

28. Governing Law

These Terms and purchase contracts are governed by German law, excluding the United Nations Convention on Contracts for the International Sale of Goods.

For consumers, this choice of law does not remove mandatory protections granted by the law of the country in which the consumer has their habitual residence where those protections cannot be contractually excluded.

29. Jurisdiction

Mandatory statutory jurisdiction rules for consumers apply.

Any exclusive jurisdiction provision applies only where legally permitted, including in transactions with merchants, legal entities under public law or special funds under public law.

30. Severability

If any provision of these Terms is invalid or unenforceable, the remaining provisions remain effective.

The invalid provision will be replaced by the applicable statutory rule. This does not alter mandatory consumer rights.

31. Changes to These Terms

We may update these Terms for future use where reasonably necessary due to legal, operational, security or technical changes.

The Terms applicable to an order are generally those made available when the order was placed, unless a later change is required by mandatory law or expressly agreed.
